These Terms of Service (“Terms”) govern your access to and use of the website(s), forms, and online services operated by Hawthorn LTC Pharmacy (“Hawthorn,” “we,” “us,” or “our”), including any related pages, content, features, or communications (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Who We Are
Hawthorn is a long-term care (“LTC”) / closed-door pharmacy that primarily serves licensed facilities and care providers. The Site is intended to provide general information about our services and to facilitate business communications.
The Site is not intended for emergency use.
2. No Medical Advice; No Provider-Patient Relationship Through the Site
The Site may contain general information about pharmacy services and medication management. Nothing on this Site constitutes medical advice or a substitute for professional medical judgment.
Using this Site, submitting a form, or contacting us does not create a pharmacist-patient relationship, provider-patient relationship, or any fiduciary relationship. Any services we provide are governed by separate agreements and applicable law.
If you believe you have a medical emergency, call 911 or go to the nearest emergency room.
3. Eligibility
You may use the Site only if you can form a legally binding contract and are not prohibited from doing so under applicable law.
4. Intellectual Property
Unless otherwise noted, the Site and all content (text, graphics, logos, designs, and compilations) are owned by Hawthorn or its licensors and are protected by intellectual property laws.
You may view and print pages from the Site for your internal business use. You may not copy, reproduce, modify, distribute, sell, or exploit any portion of the Site without our prior written consent.
5. Acceptable Use
You agree not to:
Use the Site for any unlawful purpose or in violation of any applicable law or regulation
Attempt to gain unauthorized access to the Site, accounts, systems, or networks
Interfere with or disrupt the Site’s operation or security
Upload or transmit viruses, malicious code, or harmful content
Harvest, scrape, or collect information from the Site without permission
Misrepresent your identity or affiliation when communicating with us
6. Communications and Consent
If you contact us, submit a form, or request information, you agree that we may respond using the contact information you provide (including email, phone, or text message where applicable).
Do not submit sensitive personal information (including medical information) through the Site unless we explicitly request it and provide a secure method to do so.
If we use text messaging and you opt in, message and data rates may apply and message frequency may vary. (If you implement SMS marketing, add opt-out language such as: “Reply STOP to opt out; HELP for help.”)

The Site may include links to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party sites is at your own risk.
8. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAWTHORN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HAWTHORN (OR ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAWTHORN’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED $100.
(Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.)
10. Indemnification
You agree to defend, indemnify, and hold harmless Hawthorn and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
11. Changes to the Site or These Terms
We may update the Site or these Terms at any time. The “Last Updated” date reflects the most recent changes. Your continued use of the Site after changes means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles, except where federal law applies.
13. Dispute Resolution; Venue
Any dispute arising out of or relating to these Terms or the Site must be brought in the state or federal courts located in Missouri, and you consent to the personal jurisdiction of those courts.
